Ownership of Content

  • Users retain ownership of any content they create and upload to VivoLink
  • By uploading content, users represent that they own the rights or have obtained the necessary permissions to share it.
  • Users grant VivoLink a limited license to display and distribute content within the Platform as outlined in our Terms of Service.

Prohibited Conduct

Users may not upload, post, or share content that:

  • Infringes on another person’s copyright, trademark, or intellectual property.
  • Misappropriates trade secrets, patents, or confidential information.
  • Violates applicable intellectual property laws.

Reporting Infringements (DMCA Takedown Requests)

If you believe content on VivoLink infringes your copyright or other intellectual property rights, please submit a written notice with the following information:

  • Your full legal name, address, email, and phone number.
  • A description of the copyrighted work or trademark that you claim has been infringed
  • The URL or specific location of the allegedly infringing content.
  • A statement that you have a good faith belief that the use of the content is not authorized by the rights holder, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner (or authorized to act on their behalf).
  • Your physical or electronic signature.

Counter-Notification

If you believe your content was removed in error or misidentification, you may submit a counter-notification including:

  • Your full legal name, address, email, and phone number.
  • dentification of the removed content and its prior location.
  • A statement under penalty of perjury that you have a good faith belief the content was removed in error.
  • A statement consenting to the jurisdiction of the courts of New Zealand (or your local jurisdiction if outside NZ).
  • Your physical or electronic signature.

If we receive a valid counter-notification, we may restore the content unless the complainant files a legal action within 10 business days.

Repeat Infringers

  • VivoLink has a “three-strikes” policy: repeat infringers may have their accounts suspended or permanently terminated.
  • We reserve the right to disable accounts and remove content at our discretion.

Disclaimer

VivoLink is not a legal authority. We facilitate the reporting and handling of intellectual property disputes but are not responsible for independently verifying claims. Disputes between users must be resolved between the parties or through legal channels.

Updates

We may update this Intellectual Property Policy at any time. Continued use of the Platform indicates your acceptance of any changes.
