Welcome to VivoLink! These Terms of Service ("Terms") govern your access to and use of the VivoLink website, platform, and services (collectively, the "Platform"). By using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use VivoLink.
1. Eligibility
- You must be at least 13 years old to use VivoLink.
- If you are under 18, you must have parental or legal guardian consent.
- We reserve the right to request proof of age or parental consent at any time.
2. Account Creation & Security
- You must provide accurate, current, and complete information when creating an account.
- If you are under 18, you must have parental or legal guardian consent.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify us immediately of any unauthorized use of your account.
- VivoLink is not liable for losses arising from unauthorized account use.
3. Use of the Platform
You may use VivoLink only for lawful purposes. You agree not to:

- You agree to notify us immediately of any unauthorized use of your account.

4. Services & Transactions
- Sellers may offer services such as messaging, video/voice calls, or recorded videos
- Buyers pay in advance; funds are held in escrow for 24 hours pending dispute window.
- After 24 hours, funds become available for the seller to request withdrawal.
- Withdrawals are reviewed and approved manually by VivoLink. Payouts occur between 5am–12am NZT daily.
5. Referral Program
- Influencers may generate referral links.
- When a user signs up using a referral link, they become a “referral user.”
- The referrer earns a 2.5% commission from the seller’s 80% share.
- Referral statistics and commissions are displayed in dashboards.
- VIVOLINK LIMITED retains full oversight through the admin panel.
6. Fees & Payments
- VivoLink retains a 20% commission on all completed transactions
- Payments are processed by Stripe and PayPal. We do not store card information.
- All charges are displayed in the relevant currency.
- Sellers are solely responsible for reporting and paying taxes in their jurisdiction.
- Users are responsible for any transaction fees or taxes imposed by their location.
7. Content Ownership & Licensing
- Users retain ownership of the content they create.
- By using VivoLink, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the Platform.
- You represent and warrant that you own or have the rights to any content you upload.
8. Intellectual Property & Copyright Complaints
- VivoLink respects intellectual property rights.
- If you believe your copyright has been infringed, contact support@vivolink.me with details.
- We may remove content or terminate accounts in response to valid claims.
9. Disputes & Refunds
- Buyers may initiate disputes within 24 hours of a purchase.
- Refunds may be granted if: ○ The seller fails to deliver the purchased service. ○ The delivered service is clearly not as described.
- Refunds will not be granted for subjective dissatisfaction.
- VivoLink reviews disputes on a case-by-case basis; our decision is final.
10. Termination
We may suspend or terminate accounts that:
- Violate these Terms.
- Are involved in fraud, abuse, or illegal activities.
- Are inactive for extended periods (with notice)
We may retain account and transaction data as required by law.
11. Disclaimers
- VivoLink does not provide medical, legal, financial, or professional advice.
- Any content or advice provided by sellers is their own responsibility.
- We do not guarantee that the Platform will always be secure, available, or error-free.
12. Limitation of Liability
To the maximum extent permitted by law:
- VIVOLINK LIMITED shall not be liable for any indirect, incidental, special, or consequential damages.
- Total liability shall not exceed the amount you paid to VivoLink in the past 12 months.
13. Privacy & Data Protection
- VivoLink complies with international privacy and consumer protection laws.
- Your data is stored securely on AWS servers in Sydney, Australia.
- By using VivoLink, you consent to the transfer and processing of your data internationally.
- We do not knowingly collect personal data from children under 13. If discovered, such accounts will be deleted.
14. Governing Law & Jurisdiction
- These Terms are governed by the laws of New Zealand.
- Any disputes shall be resolved exclusively in the courts of New Zealand.
15. Modifications
We may update these Terms at any time. Continued use of the Platform indicates acceptance of revised Terms. We will notify users of major changes.
